Is this BJP Govt serious enough to stop illegal infiltrators and deport them!Upananda Barhmachari | HENB | New Delhi May 24, 2015:: On 24th Feb 2015, Government in the Home Ministry admitted that infiltration along the international borders does take place but it is not happened in a  definite pattern.

“Cases of infiltration along the international borders of the country have been reported. However, no definite pattern emerges from the figures of infiltration pertaining to last three years,” Minister of State for Home, Shri Kiren Rijiju told Lok Sabha during Question Hour on the day mentioned above.

The Minister said in 2012, there were 707 incidents of infiltration along the Indo-Bangladesh border and 332 cases of infiltration along Indo-Pakistan border.

In 2013, a many as 1161 cases of infiltration have been reported along Indo-Bangladesh border and 345 similar cases along India-Pakistan border.

Rijiju said 1018 incidents of infiltration were reported along the Indo-Bangla border in 2014 while 268 such cases have reported in last year along Indo-Pakistan border.

In the first month of 2015, 86 cases of infiltration were reported along Indo-Bangla border and four such cases along Indo-Pakistan border.

From the above stereotype statements of the Minster of State in Home Affairs, it can not be estimate the huge quantum of the the Bangladeshi infiltrators in India, nor it is sufficient to understand the severity of the perpetration made by these infiltrators. It is a serious concern about the present Govt of India led by BJP that the Govt. machinery is totally failure to assess the actual numbers of infiltrators in India.

But, the same BJP leaders, very much influential to Govt, have been shouting to deport all illegal infiltrators from India time and again, after forming the Govt. beginning with its election campaigns. These are now exposed only for political gain and have no consistency at all.

The announcement by Bharatiya Janata Party president Amit Shah that the party would free Assam of Bangladeshi immigrants seems to be political rhetoric with an eye on next year’s Assembly elections.

When, Kiren Rijiju, the Ministry of Home Affairs had told Parliament on 21st April 2014, “it is not possible to have accurate data of such Bangladeshi nationals living in various parts of the country”, Shri Amit Shah, the BJP President said: “Assam polls will be for freeing the State of illegal Bangladeshi immigrants”, in an election campaign in Guwahati on April 28. What a contradictions ahead! Earlier, the PM candidate of BJP Narendra Modi told in various election campaigns that his party in Govt. would take only 15 days to deport all the illegal Bangladeshis from India on priority basis. Now, it is clear most of those dramatic lectures were just election gimmicks.

Is this BJP Govt serious enough to stop illegal infiltrators and deport them!

There was opening of a Pandora’s box in the Parliament by Shri Kiren Rijiju in infiltration matters on April 21, 2015. The ignorance, incapacity and the helpless position of the present BJP led NDA Govt for counting actual numbers of illegal infiltrators in India, their locations, criminal activities and their deportations etc. have been revealed in the statement of the Govt. In a short,  it has been exposed the present Govt as the follower of their UPA counterpart at least in this infiltration matter.  On the other hand, a very dangerous matter has came to the light that the BSF in Eastern Front is grossly failure to check the Bangladeshi infiltration in West Bengal-Bangladesh and Assam-Bangladesh Border.

On April 21, 2015, Shrimati Anupriya Patel (Apna Dal), Shri Yogi Adityanath (BJP) and  Shri Narasimham Thota (Telgu Desham) wanted to know the matter regarding Crime by Illegal Bangladeshi Immigrants through written questions as un-starred question no. 4569 in Loksabha.

The questions were as below:

“(a) the number of illegal Bangladeshi immigrants residing in the country, State/ UT-wise;

(b) whether there are reports of the said immigrants being involved in criminal activities in the country;

(c) if so, the details of such cases reported in the country during the last three years and the current year, State/UT-wise;  and

(d) the measures taken by the Government to check the infiltration and illegal stay of Bangladeshi immigrants in the country?

The reply of the Ministry of Home Affairs (MHA) was embarrassing and exposing too. In his written reply on 21/04/2015, Shri Kiren Rijiju, Minister of State (MOS) conveyed the Parliament as below:

(a): There are reports of Bangladeshi nationals having entered the country without valid travel documents. Since entry of such Bangladeshi nationals into the country is clandestine and surreptitious, it is not possible to have the accurate data of such Bangladeshi Nationals living into various parts of the country. A number of Bangladeshi nationals who have entered into India on valid travel documents have been found overstaying. In absence of an authentic/exhaustive survey, no authentic data of illegal immigrants currently staying in the country is available. However, during 2012-2014, approx. 18,000 Bangladeshi nationals were arrested in India for violating provisions of Immigration Control Rules & Regulations and under various sections of Foreigners Act. In the bordering areas, during the year 2012-2014 (upto November), 986 Bangladeshi nationals were apprehended by the Border Security Force for crossing over to territory wherein 689 Bangladeshi nationals were found innocent and handed over to Border Guard Bangladesh whereas 297 Bangladeshi nationals handed over to concerned Police station or further legal action against them.

(b) & (c): Instances of violation of the law and involvement in illegal activities by such Bangladeshi nationals have been reported. Registration of cases and action thereon comes within the purview of State Governments/ Union Territory Administrations concerned.  Statistical data of this nature are not currently maintained. Law enforcement agencies are instructed to maintain a strict vigil on the activities of such Bangladeshis in the country and take appropriate action.

(d):  Central Government is vested with powers to deport a foreign national illegally staying in the country under section 3(2)(c) of the Foreigners Act, 1946. The powers to identify and deport such illegally staying foreign national have also been delegated to State Governments/ Union Territory Administrations.

A number of steps have been taken by the Government of India to manage the Indo-Bangladesh border. These include construction of border fence and border roads in strategic land border areas. A revised procedure for detection and deportation of illegal Bangladeshi immigrants has also been set out and circulated to State Governments/ Union Territory Administrations in November, 2009, which has been partially modified in February, 2011, and further modified in February, 2013. The procedure includes sending back then and there, the illegal immigrants who are intercepted at the border while entering India unauthorisedly. Thirty six (36) Foreigner Tribunals are set up for detection of foreigners/illegal immigrants in the state of Assam. Besides, 64 numbers of Foreigners Tribunals have been sanctioned by Ministry of Home Affairs for speedier disposal of cases pending with the Tribunals”.

What a position of a Govt. that it does not know the dangerous infiltrators block in the country nor they are ready to procure it through making task forces on it. Even this Govt is not ready to contact with such agencies those who have expertise on it to highlight the facts and can make strategies. From an article written by Dr Mohit Ray, key persons in both the orgs. namely Campaign Against Atrocities on Minorities in Bangladesh (CAAMB) and Centre for Research in Indo-Bangla Relations (CRIBR) it is seen that the then Home Minister Shri Indrajit Gupta conveyed on 6th May, 1990 in the floor of Loksabha that  the number of illegal immigrants in India was about one crore. On July 14, 2004, in reply to a question in the Parliament, the Congress Minister of State for Home Affairs Sri Prakash Jaiswal informed that there 1 crore 20 lakhs 53 thousand and 950 illegal Bangladeshi in the country.

These are the recorded documents in the parliament. Then how can the present MOS in MHA just bypass the matter by saying, ‘In absence of an authentic/exhaustive survey, no authentic data of illegal immigrants currently staying in the country is available.‘ As per validated projection there are 5 crore illegal infiltrators in India, but has the BJP led NDA Govt in the Central abandoned its intention to know it to go further for action? There are so many documentations about the numbers of Infiltrators in India. Govt. of India cannot ignore its own archives and functioning agencies.

The Infiltration is connected with both the Jihad and the demographic change in India. It also has its close relation to Vote Bank politics and has its negative implications on Indian economy. So, sleepy Govt on infiltration must wake up now before it is too late to encounter the problem.

PPP Mode to check and deport infiltrators

Believing the concept of Public-Private-Partnership model, Govt. can assess and access all the data related to illegal infiltration. It may be very helpful to track the infiltrators on date and make them ready for deportation. BSF is failing to render its duties 

It is the most alarming part in the statement of MOS in MHA dt 21/04/2015 that the Border Security Force (BSF) is working so leniently (read most irresponsibly), thousands of infiltrators are being arrested inside the country but not in the border.  While 18,000 Bangladeshi nationals were arrested inside India for violating provisions of Immigration Control Rules & Regulations and under various sections of Foreigners Act etc., only 986 Bangladeshi nationals were apprehended by the BSF for crossing over to territory. These huge difference in arrests of infiltrators inside country and on border show the negligence and failure on the part of BSF.

BSF must be pro-active and should take such actions in the border that the infiltration rackets both sides in Bangladesh and India cannot dare further.
