Yet another case of brutal gang rape of Hindu woman

Hindu Women (28) gang-raped by Muslim perpetrators on 20.09.2013 at Kalkini Upazila of Madaripur District – No perpetrators has yet arrested- No justice – BDMW investigated on 15.11.2013.

As per report published by the local newspaper man Mr. Mizanur Rahman from Madaripur BDMW and GHRD jointly investigated the incident relating to gang-rape of Ms. Anita Rani Mondal on 15.11.2013. The Report is as follows:-

Name of the Victim        : Ms. Anita Rani Mondal (Housewife)

Age of the victim            : 28 years

Name of the Husband  :  Molu Mondal

Permanent Address      : Village Char Doulatkhan, U.P. CD Khan, Kalkini Upazila of Madaripur District, Bangladesh.

Date of occurrence      : 20th of September, 2013 at about 11.30 p.m.

Date of investigation    : 15.11.2013

Nature of offense        : Gang-rape on women.

Place of occurrence      : Village-Char Doulatkhan- in the house of her husband Mouza No.139, U.P. X of Kalkini police station, District – Madaripur, Bangladesh.

Name of the investigators: Adv. Rabindra Ghosh BDMW and Mr. Uttam Banarjee of HRCBM-Madaripur.

Name of the perpetrators : 1) Md. Asad Sardar (25) son of Md. Nasir Sarkar,

2) Md Sajib Khan (28) son of Manu Khan

3) Md.Kalu  Sardar (22) son of Karim Sardar

4) Md. Hafizul Sardar (25) son of Mlanik Sardar

All of village Uttar Kandi (CD Khan) P.s.Kalkini, District-Madaripur, Bangladesh.

Facts of the Case: –

Ms. Anita Rani- a Hindu girl was married to Monu Mondal as per Hindu law and their conjugal life was good but their economic condition was poor, Manu Mondal is simple van-vehicle driver earn their livelihood with scanty income.  Facts, in short, is that while on 20.09.2013 the victim- Anita Rani along with her husband at about 11.30 night were sleeping at their home after taking dinner, some unknown persons came outside their home misrepresenting that they have fallen difficulty and sought for help and requested Monu Mondal to open the door, Anita refused to open the door, but due to constant threat Monu with his lamp in hand opened the bamboo-made door of the house and four perpetrators  forcibly entered into the bed room of the victim, two perpetrators namely Md. Sajib Khan and Md.Hafizul Sardar, wrapped rounded the hands of Monu with rope and brought him outside the room and the perpetrators with a cloth covered her mouth & started to rape brutally Anita Rani one after another and Anita became senseless. After the incident the perpetrators decamped.

While Anita came to senses she cried and witnesses nearby 1) Satya Ranjan Mondal (52), 2) Gopal Mondal (40) and 3) Mde. Shahajan Kabiraj (50) came. Anita and her husband informed the police and journalist on the next day, but police neglected to come at the spot for taking necessary action against the perpetrators.

But after 5 days Anita Rani was brought to Police station at Kalkini and she was advised to lodge first information report (FI|R) ( Kalkini P.S. case No.28 dated 26.09.2013 under section 9(1) /30 of Women and Children Repression Act,2003 against four perpetrators mentioned above.

Investigation:

I, Adv. Rabindra Ghosh of BDMW and Uttam Banarjee of HRCBM –Madaripur
visited the spot, talked with the victim, her husband- Monu Mondal on 15.11.2013 at about 3 p.m. We enquired about how she was gang-raped and who the perpetrators and who witnessed the crime. The victim with shy elaborately narrated the ordeal and described the names of the perpetrators and demanded exemplary punishment of the perpetrators responsible for the crime against humanity. We have also video recorded the statements of the victims and her husband in our video camera. During our investigation Md. Nazrul Islam, Police Inspector (Investigation) Kalkini police station and I.O. of the case Md. Faisal Howlader was present. We also enquired about why the perpetrators have not yet been arrested till date of our investigation; they have given
us to understand that perpetrators are absconding. Soon after occurrence we on behalf of BDMW wanted to know from Md. Nazmul Huda-Officer-in-Charge of Kalkini police station over phone (Cell Number 01713373587) who gave us to understand that perpetrators will be brought under proper section of law. But we also observed the officer in charge – Md. Nazmul Huda most illegally registered the case as “Rape” not “gang-rape” despite ingredients of section as per statements of the victim was found relevant. We also communicated with the high officials of the police department at Madaripur who also found very much busy with other jobs.

We also scrutinized the Medical report dated 29.09.13 of the victim submitted by Medical Board wherein positive sign of rape was prevalent.

Recommendations: –

a)      BDMW & GHRD is very much concerned at the incident of gang-rape of Hindu women at Kalkini –Madariopur. We recommend urgent protection of the destitute family.

b)      BDMW & GHRD is also concerned about dilatory and perfunctory investigation process by the police officers and also very much concerned not arresting the perpetrators till writing of this report.

c)      The Minority destitute victim should be given legal assistance as per law.

d)      The victim should be given compensation for her traumatized situation now undergoing.

e)      BDMW & GHRD is also very much concerned about the F.I.R made to lodge not according to provision of law and version of the victim herself, but the section “gang-rape” has been deleted by police without any lawful authority presumably to pave the way for impunity.
